Part A: Using this website

1. Who we are

This website is run by Blue Oceans Approach (Pty) Ltd, registration number 2019/629537/07 ("Blue Oceans Approach", "we", "us"). LitreIQ is a product of Blue Oceans Approach. Contact: hello@litreiq.com.

2. Accepting these terms

By using this website you agree to Part A of these terms. If you start a trial, Part B also applies. If you do not agree, please do not use the website.

3. Information on this website

• The content is general information about LitreIQ. It is not financial, legal, tax or accounting advice.
• Calculators, examples and estimates on this website (including any return on investment or "pays for itself" figure) are models based on stated assumptions, not guarantees. Your results depend on your site, your data and how you act on what LitreIQ shows you. We do not make any representation that a particular saving will be achieved (see section 41 of the Consumer Protection Act 68 of 2008).
• Example alerts and screens marked as sample data do not describe real people or real stations.
• Prices are in South African Rand and exclude VAT unless stated otherwise.
• LitreIQ does not process payments, route money or hold card numbers.

4. Acceptable use

You may not use this website to break the law, to send spam or harmful code, to try to gain access to systems or data that are not yours, to copy the website or LitreIQ in order to build a competing product, or to submit someone else's details without their permission.

5. Intellectual property

The LitreIQ name, logo, website content and software belong to Blue Oceans Approach or its licensors. You may view and print pages for your own business use. Any other use needs our written permission. Other brand names mentioned on this website belong to their owners and are used only to describe compatibility.

6. Links

Links to other websites are provided for convenience. We are not responsible for their content or privacy practices.

7. Privacy

Our privacy notice explains how we handle personal information you give us through this website.

Part B: The 14-day free trial

8. What the trial includes

• One site.
• Read-only connections to the reports and files you choose (for example back office reports, card terminal exports, bank statements and fleet settlement files).
• File uploads and manual end-of-day capture.
• LitreIQ ProfitGuard alerts and the daily brief.

9. What the trial does not include

• No write actions: LitreIQ will not change anything in your other systems during the trial.
• No Forecourt Vision (camera evidence).
• No additional sites, and modules outside ProfitGuard only where we say so in writing.

10. No payment details to start

You do not need to give card or banking details to start the trial. The trial costs nothing.

11. Reminders and what happens after day 14

• We remind you by e-mail on days 10, 13 and 14 of the trial.
• Nothing is charged automatically. If you choose to continue after day 14, we send you an invoice with a payment link for the plan you choose. Your subscription starts when you accept it. [REVIEW NEEDED BY attorney: confirm when the subscription contract is concluded]
• If you do not choose to continue, the trial simply ends.

12. Cancelling

You can cancel the trial at any time, at no cost. On request we export your data (CSV and PDF) and then delete it within 30 days, unless you ask us to keep it longer or the law requires us to keep it.

13. If you continue: the subscription

• Plans are month-to-month. Either party may end the subscription on 30 days written notice. There is no long-term lock-in, and annual prepay is optional.
• Prices are per site per month, in South African Rand, excluding VAT. [REVIEW NEEDED BY attorney: VAT wording depends on registration status]
• A separate subscription agreement and a written POPIA operator agreement apply to paying customers. If those agreements conflict with these terms, they win.

14. Your data and POPIA

Your business data stays yours. You are the responsible party for it under POPIA, and Blue Oceans Approach processes it as your operator, on your instructions, during the trial and any subscription. You confirm that you are entitled to share the reports and files you connect or upload, including any staff information they contain. Your data is stored in South Africa. See our security page.

15. How to read LitreIQ alerts

LitreIQ highlights discrepancies so you can investigate them. An alert is not a finding that any person did anything wrong. Before acting against any employee or contractor, follow a fair process under your labour-law obligations and check the innocent causes first. You remain responsible for the decisions you take.

16. Equipment

LitreIQ does not install anything on, or change the settings of, pumps, dispensers, tank gauges, payment terminals or hazardous-area equipment. It runs in the cloud on your own devices.

17. Limits of our liability

• The trial is provided free of charge and "as is". We do our best to keep it accurate and available, but we cannot promise it will be error-free or uninterrupted. [REVIEW NEEDED BY attorney]
• To the extent the law allows, we are not liable for indirect or consequential loss, or loss of profit, arising from the website or the trial. [REVIEW NEEDED BY attorney]
• To the extent the law allows, our total liability arising from the website or the trial is limited to R1,000. [REVIEW NEEDED BY attorney: confirm cap]
• Nothing in these terms limits liability that cannot be limited by law, including any rights you have under the Consumer Protection Act where it applies to you.

18. Ending or suspending the trial

We may end or suspend a trial if it is misused, if the terms are breached, or if we need to protect the security of the service or other clients. Where reasonable, we will tell you first.

Part C: General

19. Governing law

These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction. [REVIEW NEEDED BY attorney: choose forum]

20. Changes

We may update these terms. The date at the top shows the latest version. Changes do not apply backwards to a trial already running, unless the change is required by law.

21. Notices
